Law and Statute

The Judge or Magistrate is obligated to consider the Crimes (Sentencing and Procedure) Act 1999 which enables the court to impose a lesser penalty following a guilty plea, pursuant to Section 22 of the Crimes (Sentencing and Procedure) Act 1999, or for the Court to order a dismissal of the charges without a recorded conviction pursuant to Section 10 of the Crimes (Sentencing and Procedure) Act 1999.

The court will consider the following factors in means of justifying such a decision;

The person’s character; criminal record, age and mental health
Circumstances during the time of the offence;
Nature of the offence; and
Any other matter that the court feels relevant
